SC Urges ECI to Avoid Mass Exclusion
The Supreme Court on Monday addressed a series of petitions challenging the Special Electoral Roll Revision in Bihar, especially regarding the linkage of Aadhaar with voter IDs. The bench, led by Justice Sanjiv Khanna, emphasized the need for “mass inclusion, not mass exclusion” and asked the Election Commission of India (ECI) to clarify how it planned to ensure voter rights were protected during the update.
The court expressed concern that the revision might have led to disenfranchisement of eligible voters who failed to link Aadhaar or faced document-related issues. It reminded the ECI that the right to vote is fundamental and must not be denied without due process.
Questions Raised Over Process and Timing
The petitioners argued that the process lacked proper publicity and gave insufficient time to the public, especially those from marginalized communities. Many voters allegedly discovered their names missing from the updated rolls despite being long-time residents and having valid voter IDs.
The timing of the revision—months before elections—also raised eyebrows. Critics questioned whether the abrupt revisions served political motives or logistical efficiency. The Supreme Court stopped short of declaring the process unconstitutional but asked for more data and procedural clarity from the ECI.
ECI’s Response and Future Action
In response, the ECI maintained that the roll revision followed due procedure and was not aimed at exclusion. However, the Court demanded a transparent review mechanism and directed the ECI to submit an affidavit outlining steps taken to verify deletions and include all eligible voters.
The ECI also assured that no voter would be excluded merely due to non-linkage of Aadhaar. The Court, however, pressed for accountability, warning against any violation of citizens’ democratic rights.
